Your access to and use of Isabel
Since you will receive Isabel via third party telecommunications
networks, you acknowledge that we cannot guarantee that the availability
of Isabel will be uninterrupted or error free.
Similarly we cannot guarantee that the transmission of any information

Isabel is therefore provided to you on an “as is”

and, in relation to the diagnosis reminder system, the results produced
are also dependent on the search terms inputted by you, we
cannot and do not warrant or guarantee the accuracy or relevancy
of any information or results produced on Isabel.
In particular we do not undertake to monitor every item or piece
of information included in Isabel and as a result we make no representations,
warranties or endorsements about the information included in Isabel
or its accuracy or whether such information is up to date. Nor do
we make any guarantees regarding the prompt editing or removal of
any inappropriate or inaccurate or out-of date information or materials.

Please note that due to the way in which the software operates,
numbers or formulae copied from textbooks and other resources may
become jumbled or corrupted and therefore cannot be relied on and

Viruses & other damage to computers & data
We will use reasonable endeavors in accordance with good computing
practices to ensure that Isabel is free of viruses,
but make no other representations or guarantees in that regard.
Isabel is accessed, used and any parts or materials
are downloaded by you at your own risk, and on the basis that we
are not responsible for any damage to your computer system or loss
of data that results.
No conditions, warranties or guarantees
On the basis that you are accessing Isabel for business and commercial
purposes, you agree that, unless we specifically state otherwise,
we provide Isabel to you without any conditions, warranties, or
guarantees, whether express or implied (including, but not limited
to, any implied warranties or conditions as to the satisfactory
quality, merchantability or fitness for a particular purpose, non-infringement,
or (in the USA only) title, or any warranties implied from course
of dealing or course of performance) which are expressly excluded
to the extent permitted by law.
Our Liability
We shall not be liable to you in contract, tort (including negligence)
or otherwise for:
any damage or loss arising
from the consequences of viruses received by you via Isabel
or of our failure to provide Isabel in accordance
with the Terms & Conditions; and/or
any economic losses (including loss of
profits) or any special, indirect or consequential losses,
business interruption, loss or inaccuracy of data, loss of
goodwill or reputation, or for any wasted expense including
but limited to losses caused by viruses,
and any other liability we may have to you whether
in contract, tort (including negligence) or otherwise for any loss
or damage suffered by you:
if arising due to any defects in the
software, shall be limited to the provision of support to
or replacement of the software or £500 whichever is
the lower in value; and/or
if arising otherwise in relation to Isabel,
shall be limited to £500.
Reasonableness of disclaimers and limits on our liability
You acknowledge that the disclaimers and limits on our liability
are fair and reasonable, based in part on the amount of your (or
your subscribing organization’s) subscription fee, and our
reliance on third party sources of information.
No limits or disclaimers in relation to personal injury
or death arising due to negligence
We do not limit our liability if any person dies or is injured as
a result of our negligence or suffers any loss as a consequence
of any fraud by us, and nothing in the Terms & Conditions should
be read as making any such limitations.
